End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you and Furkan Cakmaktepe (Freelance Game Developer) ("Developer", "we", "us", or "our") for the Sultan's Gambit mobile application ("Application", "App", "Game").

License Grant

Subject to the terms of this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application on your compatible mobile device solely for your personal, non-commercial use.

License Restrictions

You may NOT:

• Copy, modify, or distribute the Application
• Reverse engineer, decompile, or disassemble the Application
• Remove or alter any proprietary notices or labels
• Use the Application for any commercial purpose
• Transfer or sublicense your rights under this EULA
• Use the Application in violation of any applicable laws

Ownership

The Application and all intellectual property rights therein are and shall remain the exclusive property of the Developer. This includes but is not limited to:

• Source code and object code
• Graphics, artwork, and visual elements
• Audio files and music
• Text content and storylines
• Game mechanics and algorithms
• Trademarks and trade names

Third-Party Content

The Application may contain third-party content subject to separate license terms. Such content remains the property of its respective owners.

Your Content

You retain ownership of any content you create within the Application (such as player names, deck configurations). However, by using the Application, you grant us a worldwide, royalty-free license to use, display, and distribute such content as necessary to operate the Application.

Content Standards

Any user-generated content must comply with our Terms of Service and applicable laws. We reserve the right to remove or modify content that violates these standards.

Data Collection

Your use of the Application is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Application, you consent to such collection and use.

GDPR Compliance

If you are located in the European Union, you have additional rights under the General Data Protection Regulation (GDPR) as outlined in our Privacy Policy.

Virtual Currency and Items

The Application may offer virtual currency (Akçe, Elmas) and virtual items (cards, packs) for purchase with real money. These virtual items:

• Have no real-world value
• Cannot be transferred outside the Application
• Cannot be exchanged for real money or other goods
• May be modified or removed at any time

Purchase Terms

• All purchases are final and non-refundable except as required by law
• Purchases are processed through the Apple App Store
• We are not responsible for unauthorized purchases

Application Updates

We may provide updates, patches, or new versions of the Application. You agree to accept such updates, which may be installed automatically depending on your device settings.

EULA Modifications

We may modify this EULA at any time. Significant changes will be communicated through the Application or via email. Your continued use constitutes acceptance of the modified EULA.

Termination by You

You may terminate this EULA by uninstalling the Application and destroying all copies in your possession.

Termination by Us

We may terminate this EULA immediately if you breach any terms. Upon termination:

• Your license to use the Application ends immediately
• You must stop using the Application and delete all copies
• Certain provisions survive termination

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Error-free operation
• Uninterrupted service

Device Compatibility

We do not warrant that the Application will be compatible with all devices or operating system versions.

Liability Limits

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability is limited to the amount you paid for the Application in the last 12 months
• We are not liable for indirect, incidental, consequential, or punitive damages
• We are not liable for loss of data, profits, or business interruption

Essential Purpose

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless the Developer from any claims, damages, losses, or expenses arising from:

• Your use of the Application
• Your violation of this EULA
• Your violation of any third-party rights
• Your breach of any applicable laws

Governing Law

This EULA is governed by German law, without regard to conflict of law principles.

Dispute Resolution

Disputes arising under this EULA will be resolved through:

• Good faith negotiation
• Mediation if negotiation fails
• Binding arbitration under DIS (German Institution of Arbitration) Rules

Jurisdiction

For disputes not subject to arbitration, the courts of Germany shall have exclusive jurisdiction.

App Store Acknowledgment

This EULA is between you and the Developer only, not with Apple Inc. ("Apple"). Apple is not responsible for the Application or its content.

Apple's Rights and Obligations

• Apple has no obligation to provide maintenance or support
• Apple is not liable for any claims related to the Application
• You may contact Apple for refunds according to their policies
• Apple is a third-party beneficiary of this EULA

Additional Terms

Your use of the Application must comply with Apple's App Store Terms of Service and any applicable usage rules.

You acknowledge that the Application may be subject to export restrictions. You agree not to export or re-export the Application in violation of applicable laws.

Entire Agreement

This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and us regarding the Application.

Severability

If any provision of this EULA is found unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any provision does not constitute a waiver of our rights.

Assignment

We may assign this EULA without notice. You may not assign your rights under this EULA.
